The Fire Department accepts subpoenas for records and appearances related to official Fire Department business ONLY. 
No subpoenas concerning personal matters shall be accepted.

All subpoenas must be served as per the California Evidence Code and cannot be accepted through mail or electronic delivery. 

PLEASE NOTE: No subpoenas will be accepted at SFFD Headquarters.  Please follow the instructions below for serving subpoenas.
 
 

SUBPOENA ad testificandum - for Fire Department Member Testimony

All subpoenas regarding a fire or medical incident that request a Fire Department member to appear at a legal hearing or trial for oral testimony (subpoena ad testificandum) MUST be hand-delivered AND include a $275 fee (check made payable to "San Francisco Fire Department").  For criminal subpoenas, a fee is not required.

PLEASE NOTE: NEW FEE INCREASE AS OF 1/1/13 (CA Govt. Code §68097.2, per AB 2612)

To ensure efficient service, please call ahead to arrange a drop-off time with the Custodian of Medical Records by calling Custodian of Medical Records.  Subpoenas received incomplete or without payment shall be subject to denial.

SUBPOENA duces tecum - for Fire Incident/Investigation Records; other non-medical Fire Department Records

All subpoenas requesting the production of records produced in response to a non-medical fire incident, personnel records, or business records for use as evidence in a court of law (subpoena duces tecum) MUST be hand-delivered AND include a $15 fee (check made payable to "San Francisco Fire Department").  For criminal subpoenas, a fee is not required.

To ensure efficient service, please call ahead to arrange a drop-off time with SFFD Bureau of Fire Investigation staff by calling Bureau of Fire Investigation.  Subpoenas received incomplete or without payment shall be subject to denial.
