Sample Resident's Statement for Building Owners

 

 

This requirement applies to all buildings with 3 or more dwelling units.

A record of owners’ compliance with SFFC Section 409.2 shall be maintained by requesting tenants to complete a Resident’s Statement.

A Resident’s Statement indicates the tenant has received the Tenant Fire Safety Disclosure Information.

Response shall be transmitted to the owner within 20 business days.

A Resident’s Statement shall be obtained every year, 20 business days after the resident has received the Tenant Fire Safety Disclosure Information.

If owner does not receive the Resident’s Statement within 20 business days, owners shall complete an Owner’s Statement form.

Copies of Resident’s Statement shall be retained for at least two years.

 

If your building does not have a common area to post the Posted Disclosure Information, Annual Smoke Alarm Information Notice, List of Tenant's Rights Organizations and the Statement of Compliance Form, as they apply to your building, then these documents shall be provided directly to the tenants, similar to what is required for the Tenant Fire Safety Disclosure Information.

Building owners with buildings in this situation shall adjust the Resident’s Statement letter for their tenants to identify the date that the resident received the Tenant Fire Safety Disclosure Information, and include listing the Annual Smoke Alarm Information Notice, List of Tenant’s Rights Organizations and, if the building has an existing fire alarm system, the Statement of Compliance Form.  For guidance, see sample letter:
